Authorized by the General Assembly in 2005, the Maryland Commission on Public Art was appointed in 2007 (Chapter 393, Acts of 2005). In March 2008, the Commission had its inaugural meeting.

The Commission administers the Maryland Public Art Fund, which was established to commission works of art for installation at public facilities statewide. To ensure that new public facilities constructed by State agencies include the installation of artwork, the Commission is charged also to work with the Department of General Services, the Department of Transportation, and the University System of Maryland. Any artwork obtained through the Fund is to be the responsibility of the Maryland Historical Trust.

Eleven members constitute the Commission. Seven of these are appointed by the Secretary of Commerce with the Governor's approval. Four members serve ex officio. The Chair is designated by the Secretary of Commerce with the Governor's approval (Code Economic Development Article, secs. 4-601 through 4-608).
