In July 2015, the Maryland Cybersecurity Council was authorized by the General Assembly (Chapter 358, Acts of 2015).

The Council’s charge is to assess the cybersecurity risk of critical infrastructure in Maryland; assist those critical infrastructure entities not covered by federal Executive Order no. 13636 in meeting federal cybersecurity guidance; encourage and assist private sector firms to adopt the National Institute of Standards and Technology Cybersecurity Framework; and identify regulatory inconsistencies between federal and State cybersecurity law that may complicate compliance by Maryland businesses.

If cyber damage or unauthorized cyber access to infrastructure could reasonably result in catastrophic consequences, the Council uses federal guidance to identify categories of critical infrastructure as critical cyber infrastructure. The Council also assists infrastructure entities and cybersecurity businesses to comply with federal cybersecurity guidance.

State and federal laws regarding cybersecurity are examined by the Council, and proposed changes are recommended. Moreover, the Council is to recommend a comprehensive State Strategic Plan to ensure a coordinated and adaptable response to and recovery from cybersecurity attacks.

The Council consists of more than fifty members. The Attorney General chairs the Council (Code State Government Article, sec. 9-2901).
